I hereby acknowledge that I am voluntarily participating in the Shore-2-Shore Indian Ocean Odyssey, scheduled to take place on 10-12 February 2024, organized by Swim in Common (hereinafter referred to as "the Swim").
In consideration for being permitted to participate in the Swim, I, on behalf of myself, my heirs, executors, administrators, and assigns, do hereby release, waive, discharge, and covenant not to sue Swim in Common, its officers, directors, employees, agents, volunteers, sponsors, and all other persons or entities associated with the Swim (collectively referred to as "the Released Parties"), from any and all claims, liabilities, demands, actions, or causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the Released Parties or otherwise, while participating in the Swim in the locations where the Swim is being conducted.
I acknowledge that participating in the Shore-2-Shore Indian Ocean Odyssey involves certain inherent risks, including but not limited to the risk of drowning, injury, and death. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me as a result of participating in the Swim, whether caused by the negligence of the Released Parties or otherwise.
I further agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and attorney fees, that may be incurred by the Released Parties as a result of any action or inaction on my part.
I have carefully read this Waiver and Release of Liability, and I fully understand its contents. I am aware that by signing this document, I am waiving certain legal rights I or my heirs, executors, administrators, and assigns may have against the Released Parties.
I understand that this Waiver and Release of Liability is a binding legal document and that I am signing it of my own free will.
